1. Agreement
NursingHomesInEachState.com (“the site,” “we,” “us”) is an independent nursing home directory. By using the site you agree to these Terms & Conditions and to our Privacy Policy. If you don’t agree, please don’t use the site.
2. Not medical advice
The site provides general information about nursing homes for research and comparison. It is not medical, legal or financial advice and is not a substitute for advice from a doctor, social worker, discharge planner or other qualified professional. We are not a nursing home, a health care provider or a placement agency, and we don’t recommend any particular home. Star ratings, staffing figures, inspection results, fines and other measures describe past performance and may not reflect the care a resident would receive. Read each home’s latest inspection report and visit in person before you decide.
3. The data and its accuracy
The ratings, staffing, inspection, penalty and other figures on the site come from the Centers for Medicare & Medicaid Services (CMS) Provider Data Catalog, as described on About the data. We update the data when CMS publishes it, but CMS publishes on its own schedule, homes open, close, change owners and change their details, and errors can occur in the source data or in how we display it. Always confirm important details, such as whether a home has a bed available, which insurance it accepts, its address and its phone number, directly with the home.
The site is independent. It is not affiliated with, endorsed by or sponsored by CMS, Medicare, Medicaid, any government agency, or any nursing home or operator listed. Nursing home names belong to their owners and are used only to identify them.
If you find a mistake, please tell us and we will check it against the CMS data.
4. Featured listings
Nursing homes can pay a flat fee for a featured listing, which adds the home’s own photos and description and can show a card above or beside a city’s list. Featured listings are always labeled as paid. They never change a home’s CMS data or ratings and never change the order of any ranked list. Only homes in good standing with CMS are eligible, as explained on How we make money. Text and photos in a featured listing are supplied by the home, not written or checked by us, and featuring a home is not a recommendation.
Nursing homes that buy a featured listing agree to the pricing and terms we send them in writing, and confirm that they have the right to use any photos and text they give us.
5. Using our content
The underlying CMS data is in the public domain. The site’s compilation of that data, its lists and analysis, its writing, design and code belong to us and are protected by copyright and other laws.
- You may share links to any page and quote short passages or individual figures, with a credit to NursingHomesInEachState.com and a link to the page you used.
- You may not copy or republish substantial parts of the site, or its pages in bulk, as your own directory or website.
- You may not imply that we, or any nursing home listed, endorse you or your product.
6. Acceptable use
When you use the site, you agree not to:
- Scrape, crawl or download the site with automated tools in a way that puts a heavy load on it, gets around rate limits or security measures, or ignores our robots.txt file.
- Click on ads you aren’t interested in, or encourage or use automated means to generate ad impressions or clicks.
- Try to gain unauthorized access to the site, its servers or its database, or interfere with how it works.
- Submit spam, false reports, or anything unlawful, abusive or infringing through our forms.
- Request a featured listing for a home you aren’t authorized to represent.
We may block access to anyone who breaks these rules.
7. What you send us
When you send a correction, comment or other message, you confirm that it is accurate to the best of your knowledge and that you have the right to share it. You give us permission to use it to review and improve the site. We display CMS data as CMS publishes it, so a report may lead us to check our display or point you to CMS rather than change a figure. We won’t publish your name or email address. Please don’t send personal health information.
8. Ads, links and third parties
The site is supported by advertising, including ads from Google, and by featured listings. Ads are provided by third parties. We don’t endorse the advertisers or products shown, and we are not responsible for them. Links to other websites, including nursing home websites, are provided for convenience. We don’t control those websites and are not responsible for their content or privacy practices.
9. Disclaimers
The site and all of its content and data are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, secure or free of errors.
10. Limitation of liability
To the fullest extent permitted by law, Nursing Homes In Each State and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any decision made or action taken in reliance on the site, including the choice of a nursing home, arising from your use of the site or its data. Our total liability for any claim relating to the site is limited to one hundred U.S. dollars ($100).
Some jurisdictions don’t allow some of these limits, so they may not apply to you. You agree to indemnify us against claims arising from your misuse of the site or your violation of these terms.
11. General
If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a part of these terms is not a waiver of our right to enforce it later. These terms are the entire agreement between you and us about the site, except that a separate written agreement for a featured listing also applies to that listing.
12. Changes and contact
